Terms of Service

These Terms of Service outline the conditions that apply when accessing services provided by Brain Sprout Clinic. They should be read alongside our Privacy Policy, Fees, Payments, Cancellations & Refunds Policy, Consent to Services, Complaints & Feedback Policy and Client Rights & Responsibilities.

 

By accessing services from Brain Sprout Clinic, you agree to these Terms of Service and any service-specific arrangements agreed with you.

 

About Brain Sprout Clinic

Brain Sprout Clinic provides diagnostic and psychometric assessment services and therapeutic supports for children, adolescents and adults.

 

Services may be provided by psychologists and other appropriately qualified allied health professionals. Assessments are led by a registered psychologist and may involve other members of our multidisciplinary team where clinically appropriate and with appropriate consent.

 

The nature and scope of services provided will depend on the individual's needs, the purpose of the service and clinical judgement.

 

Assessment Services

Assessment services may include clinical and developmental interviews, questionnaires, standardised assessment measures, observation, review of relevant records and reports, information from parents, caregivers, teachers or other professionals, scoring and interpretation, clinical consultation, feedback and preparation of a written report.

 

The specific assessment activities used are determined according to the referral question, available information and individual circumstances. An assessment plan may be adjusted where clinically appropriate as further information becomes available.

 

Assessment involves consideration of information from multiple sources together with professional clinical judgement. No individual test, questionnaire, interview or observation determines a diagnosis on its own.

 

Brain Sprout Clinic does not guarantee that an assessment will result in a particular diagnosis, recommendation, funding outcome, educational adjustment or eligibility for another service.

 

In some circumstances, further information, monitoring, referral or additional assessment may be recommended before conclusions can be reached.

 

Therapeutic Services

Brain Sprout Clinic may provide therapeutic services where these are within the clinician's professional scope and considered appropriate for the individual.

 

The nature, goals and expected approach to therapy will be discussed with you. Therapeutic outcomes cannot be guaranteed and may be influenced by individual circumstances, participation and factors outside Brain Sprout Clinic's control.

 

Consent

Informed consent is required before services commence and is an ongoing process throughout your involvement with Brain Sprout Clinic.

 

You will be provided with information about the nature and purpose of the service and will have opportunities to ask questions. You may withdraw your consent at any time.

 

If consent is withdrawn, we will explain any implications for your service. For an assessment, withdrawal may mean that we are unable to complete the assessment, reach a diagnostic conclusion or prepare a report.

 

Withdrawal of consent does not affect services already provided or fees already incurred.

 

Children and Young People

Where services are provided to a person under 18 years of age, Brain Sprout Clinic must be satisfied that appropriate authority to consent to the service has been established.

 

Parents, guardians and other authorised decision-makers must inform Brain Sprout Clinic of any parenting orders, guardianship arrangements, child protection involvement, care arrangements or other circumstances that may affect authority to consent to services, make decisions or access information.

 

Where parental responsibility is shared, Brain Sprout Clinic may require consent from all individuals with relevant legal decision-making responsibility unless otherwise permitted by law.

 

We may request relevant documentation before commencing or continuing services. Where authority is unclear or disputed, services may be delayed or paused until the appropriate authority can be established.

 

Children and young people will be supported to understand and participate in decisions about their services in a way that reflects their age, development, capacity and communication needs.

 

Appointments

Appointments are scheduled for a particular client, clinician, service and period of time.

 

Please arrive or be available at the agreed appointment time. If you arrive late, the appointment may need to finish at the originally scheduled time to avoid affecting other clients.

 

Some assessments may be completed in one appointment, while others may be completed across multiple appointments. Breaks and adjustments may be incorporated where appropriate.

 

Brain Sprout Clinic may need to reschedule an appointment due to clinician illness, safety concerns or circumstances outside our reasonable control. Where this occurs, we will contact you and arrange an alternative appointment where possible.

Service Locations

Depending on the service and clinical appropriateness, services may be provided at a client's home, school, an agreed community location or by telehealth.

 

We will work with clients and families to determine an appropriate setting while considering the purpose of the service, individual needs, privacy and safety.

 

Brain Sprout Clinic may determine that a requested location is not appropriate for a particular assessment or service and may recommend an alternative.

 

Telehealth

Telehealth services may be provided by telephone or Microsoft Teams where appropriate.

 

Clients are responsible for participating from a reasonably private and suitable environment and for considering the privacy and security of their own devices and internet connection.

 

Telehealth can involve limitations, including technical difficulties and risks associated with electronic communication. If technical difficulties prevent an appointment from proceeding appropriately, an alternative method or appointment may be arranged.

 

Information and Clinical Records

Clients and authorised representatives are encouraged to provide accurate and relevant information that may assist with the service.

 

Where appropriate and with relevant consent or authority, Brain Sprout Clinic may obtain information from other people or organisations, including parents, caregivers, partners, teachers, schools, medical practitioners, allied health professionals and support providers.

 

Information obtained during a service forms part of the clinical record and is managed in accordance with our Privacy Policy.

 

If information reasonably necessary to provide or complete a service is unavailable, this may limit the conclusions that can be reached or Brain Sprout Clinic's ability to provide the service.

 

Confidentiality

Information obtained through Brain Sprout Clinic services will generally remain confidential and will only be shared with appropriate consent or authority, except where disclosure is otherwise permitted or required by law.

 

This may include mandatory reporting obligations, court orders or subpoenas, certain circumstances involving a serious threat to a person's life, health or safety, or other circumstances where disclosure is authorised or required by law.

 

Clinicians may participate in professional supervision, peer consultation and multidisciplinary case discussion. Information will be treated confidentially and identifying information limited where reasonably possible.

Reports

Where a written report is included in an assessment service, the report will be based on information reasonably available to the clinician at the time of assessment.

Reports reflect the clinician's clinical judgement at the time they are prepared. Additional or subsequently obtained information may affect assessment conclusions or recommendations.

 

Reports are prepared for the purpose discussed with the client or authorised representative. Brain Sprout Clinic cannot guarantee that another organisation will accept a report for a particular purpose or that the report will result in access to funding, supports, services, educational adjustments or other benefits.

 

Reports will only be provided to other people or organisations with appropriate consent or authority, except where disclosure is otherwise permitted or required by law.

 

Fees and Payment

Fees will be communicated before services commence or before additional services are agreed.

 

Assessment fees may be paid in full or, where agreed, progressively as individual components of an assessment are provided. Components may include direct assessment, interviews, testing, feedback, report preparation or other agreed services. Where an assessment is paid progressively, the component fees will contribute towards the total agreed assessment fee.

 

Clients are responsible for payment of fees in accordance with the agreed payment arrangements.

Medicare, NDIS, Private Health Insurance and Other Funding

Services may be privately funded or, in some circumstances, eligible for funding or rebates through Medicare, private health insurance, the NDIS or another funding arrangement.

 

Medicare rebates are only available for eligible services where applicable Medicare requirements are met, including any required referral or assessment plan.

 

NDIS funding may be accepted where the service and participant's funding arrangements permit.

 

Brain Sprout Clinic does not determine eligibility for Medicare, NDIS, private health insurance or other third-party funding. Clients are responsible for confirming their eligibility and remain responsible for any fees not covered by the relevant funding or rebate arrangement.

 

Cancellations, Rescheduling and Refunds

Cancellation and rescheduling requirements, applicable fees and circumstances in which refunds may be provided are set out in our Fees, Payments, Cancellations & Refunds Policy.

 

By booking and proceeding with a service, you agree to comply with the payment, cancellation and rescheduling arrangements applicable to that service.

 

Communication

Brain Sprout Clinic may communicate with clients and authorised representatives by telephone, email, SMS, practice management systems or other agreed methods for matters relating to services.

This may include appointment information, reminders, questionnaires, forms, reports, invoices and other administrative or clinical communications.

Electronic communication carries inherent privacy and security risks. Please advise us if you have particular communication, accessibility or privacy requirements.

 

Professional Boundaries

The relationship between clients and Brain Sprout Clinic clinicians is a professional healthcare relationship.

 

Clinicians will maintain professional boundaries and provide services in accordance with the ethical, professional and regulatory requirements applicable to their profession.

 

Respectful and Safe Services

Brain Sprout Clinic is committed to providing services in an environment that is safe and respectful for clients, families, clinicians, staff and others involved.

 

Clients and other people involved in services are expected to communicate and behave respectfully. Threatening, abusive, discriminatory, harassing or unsafe behaviour may result in an appointment being ended, services being paused or services being discontinued where reasonably necessary to protect the safety and wellbeing of those involved.

Declining, Pausing or Ending Services

Clients may choose to discontinue services at any time.

 

Brain Sprout Clinic may decline, pause or discontinue a service where appropriate, including where the requested service is outside our professional scope, is not clinically appropriate, appropriate consent or authority cannot be established, there are significant safety concerns, fees remain outstanding, or circumstances prevent us from providing the service safely, ethically or professionally.

 

Where reasonably appropriate, we will discuss this with you and provide information about alternative services or next steps.

 

Fees may remain payable for services or components already provided or completed before the service ends.

 

Complaints and Feedback

Clients have the right to provide feedback or make a complaint about Brain Sprout Clinic or the services they receive.

 

Making a complaint will not result in unfair treatment or disadvantage when accessing appropriate services.

Privacy

Brain Sprout Clinic collects, uses, stores and discloses personal and health information in accordance with applicable privacy requirements and our Privacy Policy.

Changes to These Terms

Brain Sprout Clinic may update these Terms of Service from time to time to reflect changes to our services, policies, professional requirements or applicable laws.

The current version will be published on the Brain Sprout Clinic website. Where a change materially affects an existing service arrangement, we will take reasonable steps to inform affected clients where appropriate.
